Without Prejudice Yourself -v- The Governor and Company of the Bank of Scotland Claim No SE4/07 Dear Mr MacDonald I have received and have been dealing with the proceedings which you have issued against The Governor and Company of the Bank of Scotland ("Bank of Scotland") in the Sheriff Court. Your claim relates to bank charges debited to your credit card account. These charges were debited to your account in accordance with the account terms and conditions, which you agreed to accept, and by which you are bound. I have returned the form of Acknowledgment of Service to the Sheriff Court indicating that the Bank of Scotland intends to defend your claim. However, on a purely commercial basis, it will cost the Bank of Scotland money to defend your claim in terms of the legal costs that will be incurred. It is unlikely that the Bank of Scotland will be able to recover these costs (even if the bank wins) because your claim will probably be allocated to the small claims track, in which costs are not generally awarded. [this bit is not true - it is NOT a small claims action so they are bullshitting. Also "small claims track" refers to the English Court system] For this reason, but without admission of liability, the Bank of Scotland is willing to reimburse £400.00 in respect of the bank charges incurred, £10.00 in respect of your Data Protection Subject Access fee, £10 in respect of your own administrative costs, together with £371.56 in respect of approximate interest that you have calculated. The Bank of Scotland will also reimburse £39.00 in respect of the Court fee plus £13.59 in respect of the Sheriff's cost of serving the summons. This amounts to £844.15. As discussed, I will arrange for £52.59 (the expense in bring the claim) to be refunded to your bank account and the remainder will be refunded to the credit card. This settlement agreement is on conditions that you drop the non-monetary part of your claim ("the removal of derogatory information passed to credit reference agencies") and will not pursue that element of the claim. Could you please confirm you are willing to accept this settlement as full and final settlement of the above claim on the terms proposed in this letter. We are keen to help you avoid any unnecessary charges in the future by providing various ways to keep track of your account. You can do this via telephone banking on, online banking or by obtaining a mini statement at our cash machines. You can also contact one of our banking advisers at any of our branches. We have recently reduced our fees to a level deemed acceptable by the Office of Fair Trading, therefore, future valid charges will stand and we reserve the right to terminate our agreement with you and close your account if you do not manage your account correctly in line with the terms and conditions. I was only over my credit card limit for a few months anyway because of the charges, so my credit rating isn't that bad. In any case, if I lost I'd have to pay the Banks expenses in full since I'm out the small claims, which would probably bankrupt me. |

Right, I have had another phone call from the Banks solicitors. They have a new settlement offer. They will pay out my claim in full if I drop my defamation suit.
I'm going to speak to my lawyer about this tomorrow at 1 pm - and have rejected their new offer in the interim. But I don't see how they have a case on this.
I think the Bank is running scared. |

Just been on the phone to HBOS legal services. Its going to court.
They only offered charges +8%. They said they did they did not think I was entitled to interest debited to my credit card account and I would have to prove in court that I was. I said I'd be quite confident of that. We agreed it would be fought out over in court.
He said feel free to call me if you change my mind. I said not a chance, but feel free to call ME if YOU change YOUR mind!

| Lawsuit Update: The Bank are defending! |

I've just been on to the Sheriff Clerks office in Cupar Sheriff Court. The Bank intend to defend the claim in its entirety. I haven't had the Bank's statement of defence yet, though I'm sure I have to by the court date.
The case will now call in court on Wednesday 2nd May at 1100... |

This I did by posting on Nineteenth day of March Two Thousand and Seven years at The Post Office, Crichton Street, Dundee, a service copy Summons in Form 1B with citation attached in a First Class Recorded Delivery envelope addressed as follows:- "The Governor and Company of the Bank of Scotland, The Mound, Edinburgh, EH1 1YZ" per postal receipt attached hereto.

It amuses me greatly I had to go through all this hassle with Sheriff Officers (and a £15 bill - reclaimable) for some guy just to put my court papers in an envelope and walk down to the local post office.

Had an irate phone call from "Mrs Stewart" to ask me about "guests I had last night". She has counted no less than EIGHT cigarette butts outside. She is "very cross" about this. I had to clean it up IMMEDIATELY.

I was browsing the web out of boredom, and had a look at the court lists in Cupar, to see if I recognise anyone on the criminal lists. I discovered I am due to appear at Cupar Sheriff Court in two days time. It's for a preliminary hearing in my case -v- The Governor and Company of the Bank of Scotland. So... good job I checked then. Thankfully I managed to get it sorted, after telling the Sheriff Clerk's office (again) that my case is settled. Someone else is suing the Bank of Scotland straight after me too. It must be the season. The list (http://www.scotcourts.gov.uk/rolls/sheriff/lists/cpr/cpr060830.htm)is somewhat amusing - Fife Council is suing no less than 14 different people in just that day in Cupar Sheriff Court. Must remember to get the council tax sitch sorted WELL in advance for the first semester then.
Also out of boredom, I found a train simulator that lets you drive a train from Edinburgh to Aberdeen. With realistic scenery down to a tee, and all the correct train noises. Why someone invented that I'll never know.
I'm currently working on careers stuff. I'm feeling a lot better now I'm looking at various options. Its actually quite exciting.
Otherwise, praying for the 13th September. It can't come too soon.

I got a pleasant surprise today, being in a large article in the St Andrews Citizen about my lawsuit reclaiming bank charges and an equal amount with respect to damages. Being in the paper for achieving something good kind of makes me feel all warm and centred.

On my lunchbreak in St Regs. Having a lie down, and updating livejournal (and also facebook) thanks to Margaret Minick's unsecured wireless connection.
I've definately had enough of cleaning rooms and its only day 3 of my week at Regs. Roll on Freshers week.
Going to careers later today. Hopefully they might be of some use. I've spent the best part of a decade avoiding them, so it's time to bite the bullet... |

Regular readers of this fine journal will no doubt remember me being told about my discovery that I am of direct descent to Somerled, Lord of the Isles. On perusing the web tonight (out of boredom) I have now decided that joining the Clan Donald Society would be the next logical step. It costs £16, and requires my application to pass through the High Council of the Clan Donald Chiefs but, on balance, it is probably worth it. My application should go smoothly given that I am related directly through blood to the MacDonald of Clan Ranald branch. Our Clan motto is "All hope is constant in thee".
Moreover, I get magazines and a prestigious clandonald.org.uk email address as well as other benefits. And of course, a Clan guide detailing how I should behave as a MacDonald in common emergency situations such as a Campbell turning up on the doorstep.
I'm even thinking of learning Gaelic next semester in my own time. |

Memo to all in St Andrews: They are changing the photocopy machines and currently for today, photocopying is free. Yes, free. So get stuck in.
I'm in the library now actually doing family research. My Grandmother has been doing a lot of family background research. Apparently I am a direct descendant of Somerled, Lord of the Isles who had a huge Scottish dynasty in the 12th Century. I am a full, bona fide MacDonald it seems going back. I might join some sort of Clan thing, get the MacDonald crest for the new flat in Howard Place etc I think.
Bank of Scotland are really such a pain in the ass. They seemingly arbirarily cancelled my charitible direct debit to the Cats Protection League without reason, and without permission. Firing off an email to Customer Relations about this as we speak.
As the Bank will no doubt appreciate, the whole incident has caused the Cats Protection League additional costs, which neither myself or the League are responsible for. I am therefore suggesting the Bank makes a suitable donation to the Cats Protection League in order to seek redress for this, otherwise a complaint will be made to the Financial Ombudsman which costs the Bank £360 automatically, whether the complaint is upheld or not.
As a suitable guide for the level of donation, I am referring the bank to the penalty charges it states the terms and conditions of its credit card at the time; That is a £25 for a failed direct debit and a £25 fee for late payment. I mean, someone has to think of those poor, poor cats... |

| | sentimental | ] | I'm feeling happy. I heard back from my old flatmate during session 1999-2000, Emma Sheals. I thought I'd lost touch with her. Most of you probably don't remember her but we had pretty wild times back then, especially when we lived in Melville.
Danny ( my_aphasia), Charlie ( cenobytia) and Nick ( judge_death) will of course remember her from that year in Melville 98-99. I remember my friend Sara got forced to move room from E block due to the amount of parties we had there.

I'm so hungover. I feel like death; I blame the 2.90 for double vodka red bull offer. I need one of those hospital trolleys so I can just lie there, and get someone to wheel me around as necessary.
I don't know if I can take another night out...
Got a nice Diesel T shirt yesterday a la Bank of Scotland. Its definately helping me recover from my mental anguish. I have a bit to go yet though. |

I'm currently in Canal St. It's good though kind of missing St Andrews. Man, the keys are *so* stiff on these pub keyboards. Typing is such a chore.
Waiting for dear Eleanor to appear. Got my money today from the lawsuit, bit later than promised. Only, of course, after I phoned up the bank and said if i had bank charges because of a late payment of my bank charges lawsuit, I'd have to file again. Boy did that wind them up hehe
The megabus was quite long, but they did give us a fifteen minute break to visit a marks and spencers food shop so I forgive. My ass still hurts though. |

Just to let everyone know, I'm off to Manchester as off tomorrow. I'm using my lawsuit income fund to pay for it. In other words, I'm in Manchester on the Banks funds, to help me get over my "mental anguish". I'm sure a few visits to Canal Street will do just that. I'll be sure to send the Bank a postcard...
